ETHICAL AND PERSONAL DATA PROTECTION CHARTER 

Virginie MARTINS de NOBREGA is an international lawyer and a certified mediator who advises and represents her clients before national, European, and international courts and authorities.

In 2012, she founded her practice under the name CREATIVE RESOLUTION to emphasize a dual commitment: on one hand, a pragmatic approach focused on amicable dispute resolution before any litigation, and on the other hand, a commitment to high-impact cases with an ethical, environmental, and societal approach.

In line with this commitment, the firm adheres to an ethical charter and personal data protection policy in accordance with current European and national regulations, notably the General Data Protection Regulation (EU) 2016/679 (GDPR) and the amended Data Protection Act of January 6, 1978.

LEGAL AND ETHICAL OBLIGATIONS

Virginie Martins de Nobrega is an international lawyer registered with the Paris Bar. As such, she is subject to the legal and ethical obligations of a lawyer admitted to the bar.

Virginie Martins de Nobrega is also a mediator. She is accredited to the Courts of Appeal of Paris, Versailles, and Douai. As a mediator, she is also subject to the legal and ethical obligations of mediators.

FEES

In accordance with Article 10 of Law No. 71-1130 of December 31, 1971, lawyers' fees are freely set in agreement with the client and are the subject of a fee agreement.

  • The fees can be charged as flat rate, hourly rate or hourly plus contingency fee ("success fee"). 

  • Some factors may justify an extra fee (the urgency, the special nature of services provided, new demands, etc.). 

  • Expenses and other legal costs are not included and should be paid separately by the client.

  • A retainer is usually asked upfront. 

  • The first meeting is not charged if followed by a mandate of representation otherwise it will be charged and payment is expected the day of the first meeting. 

 

We operate in transparency with our clients. A fee agreement will be systematically proposed and signed prior to the completion of any due diligence and a written consent for additional fees will be requested.

In the case of fees based on time spent, billing is carried out as the work is performed and the client is regularly kept informed.

AMICABLE DISPUTE RESOLUTION

The Firm makes every effort to respond to you as promptly as possible. If you do not receive a response from us within a period of one (1) month, do not hesitate to send us a second letter.

PERSONAL DATA PROTECTION

Collection, processing, and use of personal data

​​Your Data is collected and processed to (a) provide services or information you request and/or (b) answer your questions and requests. Such processing serves the legitimate legal interests of the Firm. 

Additionally, your data may be processed to (a) ensure the proper functioning and security of the Website, improve its functioning and adapt it to your requests and/or (b) carry out anonymous statistical analyses. Such processing serves the legitimate interests of the Law Firm as regards the proper functioning and security of the Website, and assess its audience.

The Firm may also use your Data for communication purposes to send out newsletters, information and invitations to events and conferences. Such processing serves the legitimate interests of the Law Firm, for the development of its relationships with clients, prospective clients, and partners.

 

Retention period of personal data

​The Firm keeps Personal Data only for the time necessary for the processing in place. The Firm can also keep your Personal data for a longer time as part of its legal obligations.

As regards Personal Data used for communication purposes, they are kept on file for three (3) years from the time of data collection or your last contact with the Firm. 

Right of Use

In accordance with the provisions of Articles 39 and 40 of the amended Data Protection Act of January 6, 1978, the user has the right to access their data, the right to rectification, the right to erasure ('right to be forgotten'), the right to restrict processing, the right to data portability, the right to object to processing, the right to withdraw consent at any time, and the right to set instructions regarding the fate of their data after their death.

In line with applicable law, you have the right to request access to and rectification of your Data, meaning you may ask for rectification, addition to, update or erasure of your Personal Data that is inaccurate, incomplete or obsolete. You also have the right to request restriction or to object to processing of your Personal Data for legitimate reasons.

You may also, at any time and without giving reason, oppose the processing of your Data for communication purposes.

Data controller – how to exercise your rights

The Firm acts as the controller with respect to personal data for the purposes of the GDPR.

To exercise these rights, you can therefore send your request, specifying in the subject 'Right to personal data and privacy' accompanied by proof of identity, to the following email address contact@creative-resolution.com or, by mail, to Maître MARTINS de NOBREGA, 20 rue Cambon, 75001 Paris, France.

These rights may also be exercised, upon request, by submitting a complaint at any time to the National Commission on Informatics and Liberty (CNIL) at the address 3, Place de Fontenoy, 75007 Paris, France.
